Copyright & IP Policy

This Copyright & Intellectual Property Policy explains who owns what in the Hamkke app and website (the "Service"), the rules for content you contribute, and how to report copyright infringement. It forms part of, and should be read with, our Terms and Privacy Policy. The Service is operated by [LEGAL ENTITY / OPERATOR NAME].

1. Our intellectual property

The Service — including the Hamkke name and logo, the app and website software, designs, text, graphics, the "Hamkke" brand, and all related materials we create — is owned by Hamkke or its licensors and is protected by copyright, trademark, and other laws. Except for the limited rights granted below, no rights are transferred to you.

Trademarks

"Hamkke," our logo, and our taglines are trademarks of Hamkke. You may not use them without our prior written permission, except to refer factually to the Service. All other names, logos, and marks appearing in the Service (for example Google, Apple, Spotify) belong to their respective owners and are used only to identify their products and services; their appearance does not imply endorsement.

2. Your licence to use the Service

Subject to our Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the app and access the website for your own non-commercial use. You may not copy, modify, reverse-engineer, distribute, sell, or create derivative works from the Service except as permitted by law or with our written consent.

3. Content you provide

You keep ownership of the content you create and submit — your profile text, photos, workout notes, reviews, and messages ("User Content"). To run the Service, you grant Hamkke a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute your User Content solely for the purpose of operating, providing, and improving the Service (for example, showing your profile to potential matches). This licence ends when you delete the User Content or your account, except for copies retained in routine backups for a limited period or where we must keep them by law.

You are responsible for what you upload. By submitting User Content you confirm that you own it or have the rights to share it, and that it does not infringe anyone else's copyright, trademark, privacy, or other rights, and does not break the law or our Terms. Do not upload photos, text, music, or other material you do not have the right to use.

4. Reporting copyright infringement (DMCA / takedown)

We respect intellectual property rights and respond to clear notices of alleged infringement. If you believe content on the Service infringes your copyright, send a written notice to our designated agent with all of the following (consistent with the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512):

  • Your physical or electronic signature.
  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material you claim is infringing and enough detail for us to locate it (e.g. a profile or screen).
  • Your contact details (name, address, email, phone).
  • A statement that you have a good-faith belief the use is not authorised by the owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act on the owner's behalf.

If we remove your content in response to a notice, you may send a counter-notification containing your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you believe it was removed by mistake or misidentification, your contact details, and your consent to the jurisdiction of the appropriate court. Submitting a false notice or counter-notice may carry legal liability.

5. Repeat infringers

We may remove infringing content and, in appropriate cases, suspend or terminate accounts of members who repeatedly infringe the rights of others.

6. Open-source and third-party software

The Service is built with open-source and third-party components that remain the property of their respective authors and are used under their own licences (for example MIT, Apache 2.0, BSD, ISC, and the SIL Open Font License for fonts such as Sora, Hanken Grotesk, and Space Mono). Those licences continue to apply to those components. A list of the third-party software we use and their licences is available on request at legal@hamkke.fit, and is included with the app where required.
